Fees

As a tenant you are responsible for the Council Tax, the consumption of gas, electricity, water (and oil where applicable). You are also responsible for any telephone or internet charges, as well as garden maintenance, unless this is the specific responsibility of the landlord under the terms of the tenancy agreement.

Private drainage systems should be left empty at the commencement of a tenancy (this is the responsibility of the landlord). Once a tenancy has started, the responsibility and cost of emptying the private drainage system transfers to the tenant; the system will need emptying from time to time depending on usage. Private drainage systems should be left empty at the end of a tenancy, the cost of which falls to the tenant.

If a property has oil heating, the tank should be left full at the commencement of a tenancy (this is the responsibility of the landlord). As a tenant you will be required to fill the oil tank from time to time during the tenancy (at your own cost), depending on usage. The oil tank should be left full at the end of the tenancy, the cost of which falls to the tenant.

All tenants must pay a deposit of 5 or 6 weeks’ rent prior to the commencement of the tenancy. This is held by Howard Morley and Sons, and registered with the TDS (with the exception of a company let). This is to cover any dilapidation’s, outstanding rent, or costs at the termination of the tenancy.

Television licences are the responsibility of the tenant.

Landlord Fees

Fees to Landlords are charged on an individual basis depending on the level of service required.

FULL MANAGEMENT

18% including VAT of the total rent reserved in the Agreement for any initial or supplementary term or period of occupation. If vacant, or ongoing management duties or negotiations continue, management fees are charged on the rent or rental equivalent at the rate of 6% including VAT of the final achieved rent.

Please note that we charge a minimum monthly management fee of £120 including VAT.

LET ONLY

12% including VAT of the total rent reserved in the Agreement for any initial or  supplementary term or period of occupation, to include tenant finding, reference application, collection of rent and distribution to client’s bank account (if required). On let-only properties the commission is deducted at the outset for an initial term of six months, thereafter:

a)       Monthly, where rent is collected.

b)        Or quarterly where rent is paid direct to the landlord.

TENANCY AGREEMENT

£108 – £150 including VAT for a standard Tenancy Agreement.   A specialised, one-off, Tenancy Agreement will be charged on a Quantum Meruit basis.

£30 – £48 including VAT for a lease endorsement or notice.

£144 including VAT for a termination notice.

INVENTORY

Calculated on the time taken, between £96 – £420 including VAT for preparation and check-in and £96 – £420 including VAT for checkout and re-making.

EXTRA MANAGEMENT SERVICES AND PROFESSIONAL WORK

Supervision of building works, decorating, refurbishment, re-carpeting and renewal of machines at between 6% – 9% including VAT depending on the nature of the works.

EXPENSES

International telephone calls, fax letters, car mileage, copy documentation and forwarding of post abroad.

T.D.S REGISTRATION

£42 including VAT will be charged annually.

T.D.S. DISPUTE

A minimum charge of £300 including VAT will be made to submit a claim to the T.D.S. for arbitration based on an hourly rate of £108 including VAT per hour.

INTRODUCTORY SALES COMMISSION

The landlord agrees to pay 1.2% including VAT of the sale price achieved in the event of the tenant acquiring the property during their tenancy or subsequently.

TERMINATION

Either landlord or Howard Morley & Sons may terminate this contract on one month’s written notice, subject to ongoing letting commission at the rate of 12% including VAT of the rent remaining payable to Howard Morley & Sons for the duration of the tenant’s occupancy.

CLIENT’S BALANCES

Balances are held at Lloyds Bank plc, High Street, Guildford, Surrey, GU1 3AG in a designated client’s account.  No interest is paid on balances. Any interest paid is retained by Howard Morley & Sons.  Client’s transfers are made once a month, on or around the 9th, on a weekday.

Tenant Fees

Holding Deposit – One week’s rent – to reserve a property. This will be refundable unless: the applicant withdraws from the tenancy, fails a Right-to-Rent check, provides materially false or misleading information, or fails to sign their tenancy agreement within 15 calendar days (or other deadline as mutually agreed in writing).

DEPOSIT

Rent under £50,000pa = five weeks’ rent
Rent over £50,000pa = six weeks’ rent

LOST KEY(s) or other SECURITY DEVICES(s)

Tenants will be liable for the actual cost of replacing lost keys or other security device.

VARATION OF CONTRACT – (Tenant’s Request) including a request for a change of tenant.

To cover the costs of taking landlords instructions and preparation of a new contract capped at £50.00 or reasonable costs if higher.

EARLY TERMINATION – (Tenant’s Request)

Following the request of an early termination to the tenancy, the tenant shall be liable to the landlord/landlords agent reasonable costs in re-letting the property (including the rent due) until the start date of the replacement tenancy.

Complaints Procedure

Howard Morley & Sons Ltd operates a complaints handling procedure. In the event of you being dissatisfied with the service you received from this firm, you should submit in writing the details of your complaint to Tim Morley, a Director of the firm.  Your complaint will be acknowledged and you will receive a full response within 28 days.

If you are not happy with the response to your complaint, you may refer the matter to the Property Redress Scheme (Premiere House, 1st Floor, Elstree Way, Borehamwood, WD6 1JH). Howard Morley & Sons are members of this service, our membership number is PRS012564
